This document (as well as any other referenced documents) governs the terms and conditions for the use of this Website (mc-haus.com) and the purchase or acquisition of products and/or services through it (hereinafter, Terms).
For the purposes of these Terms, the activity that BESELF BRANDS S.A. carries out through the Website includes: Sale of home products, furniture, decoration, and appliances.
In addition to reading these Terms, before accessing, browsing, and/or using this Website, the User must have read the Legal Notice, including the cookies policy, and the privacy and data protection policy of MC HAUS. By using this Website or making and/or requesting the purchase of a product and/or service through it, the User agrees to be bound by these Terms and all of the above-mentioned documents. Therefore, if the User does not agree with all of this, they should not use this Website.
Furthermore, Users are informed that these Terms may be amended. The User is responsible for checking them each time they access, browse, and/or use the Website, as the applicable Terms will be those in effect at the time of the request for the acquisition of products and/or services.
For any questions that the User may have regarding the Terms, they can contact the owner using the contact details provided above or, where appropriate, using the contact form.

2. User
Accessing, browsing, and using the Website confers the status of user (hereinafter referred to individually as User or collectively as Users), and implies acceptance of all the Conditions set forth herein from the moment browsing on the Website begins, as well as their subsequent modifications, without prejudice to the application of the corresponding legal regulations of mandatory compliance as appropriate.
The User undertakes to use the Website correctly. This responsibility will extend to:
•    Using this Website only to make legally valid inquiries and purchases or acquisitions.
•    Not making any false or fraudulent purchases. If such a purchase could reasonably be considered to have been made, it may be canceled and the relevant authorities notified.
•    Providing truthful and lawful contact details, for example, an email address, postal address, and/or other information (see Legal Notice and General Terms of Use).
The User declares to be over 18 years of age and to have legal capacity to enter into contracts through this Website.
The Website is primarily intended for Users residing in Spain. MC HAUS does not ensure that the Website complies with legislation in other countries, either in whole or in part. MC HAUS disclaims any liability that may arise from such access and also does not guarantee shipments or service provisions outside of Spain.
The User may formalize, at their discretion, the purchase contract for the desired products and/or services with MC HAUS in any of the languages in which these Terms are available on this Website.

3. Purchase or Acquisition Process
Duly registered Users may purchase on the Website using the established means and procedures. They must follow the online purchase and/or acquisition process at mc-haus.com, during which various products and/or services may be selected and added to the shopping cart or final purchase space, and finally, click on "BUY."
Likewise, the User must fill in and/or verify the information requested at each step. However, during the purchase process, before making payment, purchase data can be modified.
Subsequently, the User will receive an email confirming that MC HAUS has received their order or purchase request, i.e., the order confirmation. They will also be notified, where appropriate, by email when their purchase is being shipped. Where applicable, this information may also be made available to the User through their personal login space on the Website.
Once the purchase process has concluded, the User consents to the Website generating an electronic invoice, which will be sent to the User via email and, where applicable, through their personal login space on the Website. Additionally, the User may, if they wish, obtain a paper copy of their invoice by requesting it from MC HAUS using the contact areas on the Website or the contact information provided above.
The User acknowledges being aware, at the time of purchase, of certain specific conditions of sale related to the product and/or service in question, which are displayed along with the product presentation or image on the Website page, including but not limited to: name, price, components, weight, quantity, color, product details or characteristics, how the services will be carried out and/or their cost; and acknowledges that placing the purchase order constitutes full and complete acceptance of the specific conditions of sale applicable to each case.
Communications, purchase orders, and payments involved during the transactions made on the Website may be archived and kept in the computerized records of MC HAUS as evidence of the transactions, always respecting reasonable security conditions and the laws and regulations in force, in particular complying with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals regarding the processing of personal data and on the free movement of such data (GDPR) and Organic Law 3/2018 of December 5 on the Protection of Personal Data and guarantee of digital rights (LOPD GDD), and the rights of Users under the privacy policy of this Website.

4. Availability
All purchase orders received by MC HAUS through the Website are subject to the availability of the products and/or the absence of any circumstance or force majeure event (clause nine of these Terms) affecting their supply and/or the provision of services. If difficulties arise regarding the supply of products or products are out of stock, MC HAUS undertakes to contact the User and refund any amount that may have been paid. This also applies in cases where a service becomes unfeasible.

5. Prices and Payment
The prices displayed on the Website are final, in Euros (€), and include taxes, unless a different matter is indicated and applied by legal requirement, particularly concerning VAT.
Shipping costs are included in the final prices of the products as shown on the Website. MC HAUS provides delivery and/or shipping services through the transport companies GLS and DHL.
Under no circumstances will the Website automatically add additional costs to the price of a product or service, except those selected and chosen freely and voluntarily by the User.
Prices may change at any time, but such changes will not affect orders or purchases for which the User has already received an order confirmation.
Accepted payment methods are: credit or debit card, bank transfer, or through Paypal.
MC HAUS uses all means to ensure the confidentiality and security of payment data transmitted by the User during transactions through the Website. As such, the Website uses a secure SSL (Secure Socket Layer) payment system.
Credit cards are subject to checks and authorizations by the issuing bank. If the bank does not authorize the payment, MC HAUS will not be responsible for any delay or failure to deliver and cannot formalize any contract with the User.
Once MC HAUS receives the purchase order through the Website, a pre-authorization will be made on the corresponding card to ensure sufficient funds to complete the transaction. The charge to the card will be made at the time the shipping confirmation and/or confirmation of the provided service is sent to the User.
In any case, by clicking on "BUY", the User confirms that the payment method used is theirs.

6. Delivery
We ship to Spain (Peninsula and Balearic Islands); Portugal (excluding islands), France (excluding islands), Italy (excluding islands), and Germany. We do not ship to the following destinations: Canary Islands (Spain), Ceuta (Spain), Melilla (Spain), Corsica (France), Guadeloupe (France), Sardinia (Italy), Azores (Portugal), Madeira (Portugal).
Except for unforeseen or extraordinary circumstances or those resulting from product customization, the purchase order consisting of the listed products will be delivered within the time frame indicated on the Website according to the shipping method selected by the User and from the date of order confirmation.
If delivery is impossible due to the User’s absence, the order may be returned to the warehouse. However, the courier will leave a notice explaining where the order is and how to arrange for a new delivery.
If 30 days pass from the date the order is available for delivery and it has not been delivered for reasons not attributable to BESELF BRANDS S.A. it will be understood that the User wishes to withdraw from the contract, which will therefore be considered terminated. As a consequence of the contract termination, all payments received from the User will be refunded, except for additional costs resulting from the User’s choice of a different delivery method than the least expensive standard delivery method offered on the Website, without undue delay and, in any case, within a maximum of 14 calendar days from the date the contract is considered terminated.
However, the User should be aware that transport resulting from the contract termination may incur additional costs that may be charged.
For the purposes of these Terms, it will be understood that delivery has occurred or that the order has been delivered when the User or a third party indicated by the User acquires physical possession of the products, which will be evidenced by signing the receipt at the agreed delivery address.
Risks related to the products shall be borne by the User from the moment of delivery. The User acquires ownership of the products when MC HAUS receives full payment of all amounts due in relation to the purchase, including shipping costs, or at the time of delivery if this occurs after full payment has been received.
According to Law 37/1992, of December 28, on Value Added Tax (VAT), purchase orders for delivery and/or provision will be considered located within the Spanish VAT application territory if the delivery address is in Spanish territory except for the Canary Islands, Ceuta, and Melilla. The applicable VAT rate will be the one legally in force at the time depending on the specific item.

7. Technical Means to Correct Errors
The User is informed that if an error is detected when entering the necessary data to process their purchase request on the Website, they can modify it by contacting MC HAUS through the contact areas provided on the Website, and where applicable, through those enabled to contact customer service, and/or using the contact information provided in clause one (General Information). These corrections may also be made by the User through their personal login space on the Website.
In any case, before clicking on "BUY", the User has access to the shopping cart or basket where their purchase requests are recorded and can make changes.
Likewise, the User is referred to the Legal Notice and General Terms of Sale and specifically the Privacy Policy for more information on how to exercise their right of rectification as established in Regulation (EU) 2016/679 of the European Parliament and Council of April 27, 2016, and in Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights.

8. Returns
In cases where the User has purchased products through the owner’s Website, they are entitled to certain rights as outlined below:
Voluntary Right of Withdrawal
The User, as a consumer and user, makes a purchase on the Website and therefore has the right to withdraw from said purchase within 14 calendar days without justification.
This withdrawal period will expire 14 calendar days from the day the User or a third party authorized by them, other than the carrier, acquires physical possession of the goods purchased on the MC HAUS Website, or in the case that the goods in the order are delivered separately, 14 calendar days from the day the User or a third party acquires possession of the last of those goods, or in the case of a service contract, 14 calendar days from the date of the contract.
To exercise the right of withdrawal, the User must notify their decision to MC HAUS. They may do so through the contact areas on the Website or through:

Regardless of the method used, the User must clearly and unequivocally state their intention to withdraw from the purchase contract. The User may use the model withdrawal form provided by MC HAUS as part of these Terms, although its use is not mandatory.
To meet the withdrawal deadline, it is sufficient for the communication expressing the decision to withdraw to be sent before the expiry of the corresponding period.
In the event of withdrawal, MC HAUS will reimburse the User for all payments received, including shipping costs (except for any additional costs incurred by the User’s choice of a delivery method other than the least expensive method offered on the Website) without undue delay and in any event no later than 14 calendar days from the date on which MC HAUS is informed of the User's decision to withdraw.
MC HAUS will reimburse the User using the same payment method used in the original transaction. This reimbursement will not incur any additional cost to the User. However, MC HAUS may withhold the reimbursement until it has received the goods back or until the User has provided proof of return, whichever comes first.
The User must return the products in good condition and properly packaged in their original packaging and send them to:

And must do so without undue delay and, in any case, no later than 14 calendar days from the date MC HAUS was informed of the withdrawal decision.
The User acknowledges that they must bear the direct cost of returning the goods. Additionally, they are responsible for any decrease in value of the products resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Return of Defective Products or Delivery Errors
These are cases in which the User considers that, at the time of delivery, the product does not conform to the contract or purchase order, and therefore must contact MC HAUS immediately to report the non-conformity (defect/error), through the same means or using the contact details provided in the previous section (Right of Withdrawal).
The User will then be informed of how to proceed with the return of the products. Once returned, they will be examined, and the User will be informed (within a reasonable time) whether the refund or, where appropriate, replacement is justified. This option is subject to product availability/stock. The User cannot demand a replacement in the case of consumable products or second-hand items.
The refund or replacement will be made as soon as possible and, in any case, within 14 days from the date we send an email confirming the refund or replacement of the non-compliant item.
MC HAUS will refund or replace the product once it is received at our warehouses. Depending on how long the customer has had the product and its current market value, the following measures will apply:
•    6 to 12 months: Refund of 75% of the product value or purchase of a new one with a 45% discount.
•    12 to 18 months: Refund of 50% of the product value or purchase of a new one with a 35% discount.
•    18 to 24 months: Refund of 25% of the product value or purchase of a new one with a 25% discount.
Depending on the product condition, the customer may be required to deliver the package to a collection point indicated by MC HAUS.
The amount paid for products returned due to a defect, when such exists, will be fully reimbursed, including delivery costs and any costs incurred by the User in making the return. The refund will be made using the same payment method that the User used to pay for the purchase.
In any case, the rights recognized by current legislation for the User, as a consumer and user, shall always apply.

Warranties

Product Warranty
MC HAUS, under the legally established terms, guarantees the new products purchased on its website for a period of 3 years (2 years for purchases made before 01/01/2022), from the date of delivery.
If the product is collected for warranty management or replacement, the customer must place the item in its original packaging.
MC HAUS's liability is limited solely to the transportation, repair, or replacement costs of the products during the warranty period.
In the event of a defective product, MC HAUS will, as appropriate, proceed with the repair, replacement, price reduction, or contract termination—procedures which will be free for the consumer and user.
The consumer and user must inform MC HAUS of the lack of conformity within a maximum period of two months from becoming aware of it.
To request a repair or shipment of a part under warranty, it is necessary to open a case via our form and follow all steps until completion.
The MC HAUS Technical Service will evaluate each case and offer the most appropriate solution in each situation, with preference given to sending replacement parts and making repairs.
If the product fails during the 2-year warranty period, MC HAUS will offer a solution or compensation according to the following criteria: if an item cannot be repaired or the repair is too costly within the first 6 months, the customer may choose between a full refund or product replacement, subject to stock availability.
If the product fails after six months, the customer is still entitled to a free repair, or, if too difficult or expensive, MC HAUS will offer a partial refund based on the product’s usage:

•    6–12 months: 75% refund of the value
•    12–18 months: 50% refund of the value
•    18–24 months: 25% refund of the value

If an item is examined by MC HAUS Technical Service and found not to have failed due to a reason covered under warranty (e.g., wear, misuse, negligence), the customer will be notified and provided a quote including transportation, replacement parts, and labor costs.
If the customer refuses to pay the quote or the shipping costs to return the item, it will remain in storage awaiting collection.
Warranty repairs are themselves covered by a 3-month warranty, which does not extend the original 2-year product warranty.
The warranty does not cover deficiencies caused by negligence, knocks, improper use or handling, installation and/or use not in accordance with the instructions, or normal wear and tear.
It is mandatory that for returns due to product replacement, the item be placed in its original packaging. For repairs, if the original packaging is not available, alternative packaging that meets minimum protection standards must be used.
Outdoor-use products (e.g., foldable tents, garden furniture) will not be covered under warranty for damage caused by adverse weather conditions.
MC HAUS undertakes to provide the means to recover and repair the item at no cost during the warranty period, as long as the conditions outlined above are met.

Warranty will be void in the following cases:
•    Broken, damaged items or those with visible signs of impact.
•    Damage caused by electrical surges or overcurrent.
•    Defects caused by misuse, negligence, or abuse (drops, incorrect handling, spills, etc.).
•    Damage from pressure, twisting, humidity, extreme temperatures, sudden temperature changes, corrosion, oxidation, or exposure to chemicals or substances.
•    Modifications, repairs, or openings by unauthorized personnel or not from the MC HAUS Technical Service.
•    Motor damage due to lack of lubrication.
•    Faults resulting from poor or absent maintenance.

The warranty will not cover:
•    Failures in services or apps provided by third parties not affiliated with MC HAUS.
•    Damage due to use contrary to instructions.
•    Force majeure due to uncontrolled events.
•    Breakdowns due to normal wear.
•    Clogged or saturated air/fuel filters.
•    Spark plugs beyond 6 months from delivery.
•    Mechanical/electrical failures in generators after 300 hours of use, even if within 2 years.
•    Batteries in refurbished products, as long as the product works without one.
•    Wear-and-tear or consumable parts with a lifespan under 2 years (e.g., drills, heads, manual starters, nylon coils, chainsaw chains, tiller blades, etc.).
•    Products bought through unauthorized sales channels (only authorized: Amazon, ManoMano, CDiscount, Worten, MaisonsDuMonde, Privalia, PcComponentes, Castorama, MediaMarkt).
•    Damage caused by adverse weather conditions.
•    Products located outside the EU or in places where MC HAUS does not ship.
Any return must be authorized by MC HAUS, which reserves the right to reject shipments with unpaid postage or lacking a case number (assigned via our form). Customers may contact the company at [email protected] with any questions about installation or the function of supplied parts.
MC HAUS will not cover shipping costs for items that fall under the aforementioned warranty exclusions or annulment. Nor will it be responsible for any damage the items might suffer during transport.

 

9. Right of Withdrawal
In accordance with Spanish legislation, the customer has the right of withdrawal, by which they may return the received product if it does not meet their expectations.
This right may be exercised within a maximum period of 14 calendar days from receipt. Due to the nature of the products sold on this website, the buyer who wishes to exercise this right must not open the product, so that it remains suitable for resale.
If the buyer has opened the product, this right of withdrawal will not apply according to the exclusions contained in Article 103 of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, modified by Art. 28 of Law 3/2014, of March 27, in paragraph e).
The purchase amount will be refunded once the condition of the merchandise has been verified and the refund will be made using the same means of payment used for the order, and in any case, within a maximum of 14 calendar days from the verified receipt of the withdrawal request, provided that BESELF BRANDS S.A. handles the return shipment. If the buyer returns the product using a shipping company of their choice, the 14-day period will begin once BESELF BRANDS S.A. is effectively informed of the shipment or, failing that, upon receipt of the product.
Return shipping costs resulting from exercising the right of withdrawal will be borne by the buyer.
To exercise the right of withdrawal, the consumer must notify their decision to withdraw from the contract through an unequivocal statement.
The user must complete and submit the model withdrawal form electronically through the website mc-haus.com. By using this option, the consumer will immediately receive an acknowledgment of receipt of the withdrawal, which must be confirmed to make the withdrawal effective. To meet the withdrawal deadline, it is sufficient for the notification regarding the exercise of this right to be sent before the relevant deadline expires.

10. Disclaimer of Liability
Unless otherwise provided by law, MC HAUS shall not be liable for the following losses, regardless of their origin:
•    Any losses not attributable to any breach on its part;
•    Business losses (including loss of profits, revenue, contracts, anticipated savings, data, goodwill, or unnecessary expenses incurred);
•    Any other indirect loss that was not reasonably foreseeable by both parties at the time the contract for the sale of products was entered into.
Likewise, MC HAUS also limits its liability in the following cases:
•    MC HAUS applies all necessary measures to provide a faithful display of the product on the Website. However, it is not responsible for slight differences or inaccuracies that may exist due to screen resolution issues, browser problems, or other similar reasons.
•    MC HAUS will act with the utmost diligence in making the product available to the transport company. However, it is not responsible for damages resulting from a malfunction in the transport service, especially due to strikes, roadblocks, and any other sector-related issues causing delays, losses, or thefts.
•    Technical failures due to fortuitous or other causes that prevent the normal operation of the service via the internet. Website unavailability for maintenance or other reasons that prevent access to the service. MC HAUS puts all means at its disposal to ensure the purchase, payment, and delivery process of products, but it is not liable for causes not attributable to it, acts of God, or force majeure.
•    MC HAUS will not be responsible for the misuse and/or wear of products used by the User. Likewise, MC HAUS is not responsible for incorrect returns made by the User. It is the User’s responsibility to return the correct product.
In general, MC HAUS shall not be held liable for any failure or delay in fulfilling any of its obligations when such failure is due to events beyond its reasonable control, i.e., force majeure, which may include, but is not limited to:
•    Strikes, lockouts, or other labor disputes.
•    Civil unrest, riot, invasion, terrorist threat or attack, state of emergency, war (declared or not), or threat or preparation for war.
•    Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or any other natural disaster.
•    Inability to use trains, ships, airplanes, motor transport, or other public or private means of transport.
•    Inability to use public or private telecommunications systems.
•    Acts, decrees, legislation, regulations, or restrictions of any government or public authority.
As such, obligations will be suspended for the duration of the force majeure event, and MC HAUS will have an extension of time to fulfill them equal to the duration of the event. MC HAUS will use all reasonable means to find a solution that allows it to fulfill its obligations despite the force majeure.

11. Written Communications and Notifications
By using this Website, the User agrees that most communications with MC HAUS will be electronic (email or notices published on the Website).
For contractual purposes, the User consents to use this electronic communication method and acknowledges that all contracts, notifications, information, and other communications sent electronically by MC HAUS meet legal requirements to be in writing. This condition does not affect the User’s rights under the law.
The User may send notifications and/or communicate with MC HAUS using the contact information provided in these Terms and, if applicable, through the contact sections of the Website.
Likewise, unless otherwise stipulated, MC HAUS may contact and/or notify the User at the email or postal address provided.

12. Waiver
No waiver by MC HAUS of any specific right or legal action, or the lack of requirement by MC HAUS for the strict performance by the User of any of their obligations, shall constitute a waiver of other rights or actions arising from a contract or the Terms, nor shall it exempt the User from fulfilling their obligations.
No waiver by MC HAUS of any of these Terms or of the rights or actions arising from a contract shall take effect unless expressly stated to be a waiver and is formalized and communicated to the User in writing.

13. Severability
If any of these Terms are declared null and void by a final decision issued by a competent authority, the remaining clauses will remain in effect, unaffected by such declaration of nullity.

14. Entire Agreement
These Terms and any expressly referenced documents constitute the entire agreement between the User and MC HAUS in relation to the subject matter of sale and supersede any prior agreement, arrangement, or promise made orally or in writing by the same parties.
The User and MC HAUS acknowledge that they have entered into a contract without relying on any statement or promise made by the other party except those expressly mentioned in these Terms.

15. Data Protection
The personal data or information the User provides to MC HAUS during a transaction on the Website will be processed in accordance with the Privacy Policy (contained, where applicable, in the Legal Notice and General Terms of Sale). By accessing, browsing, and/or using the Website, the User consents to the processing of such information and declares that all data provided is true.

16. Complaints and Claims
The User may submit any complaints, claims, or comments to MC HAUS through the contact details provided at the beginning of these Terms (General Information).
Additionally, MC HAUS has official complaint forms available to consumers and users, which can be requested at any time using the contact details at the beginning of these Terms.

If a dispute arises from the purchase contract between MC HAUS and the User, the User may seek out-of-court dispute resolution in accordance with Article 14.1 of Regulation (EU) 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes. 17. Applicable Law and Jurisdiction
Accessing, browsing, and/or using this Website and the purchase of products through it shall be governed by Spanish law.
Any dispute, issue, or disagreement arising or related to accessing, browsing, and/or using the Website, or the interpretation and execution of these Terms, or contracts between MC HAUS and the User, shall be submitted to the non-exclusive jurisdiction of Spanish courts and tribunals.
